
As a state agency, the Department of Insurance is required to comply with South Carolina's Freedom of Information Act (FOIA) as mandated in Section 30-4-10 of the South Carolina Code. The Department's examination work papers, open investigation files, and items filed to comply with a special request of the Director of Insurance are exempt from FOIA disclosure.
A written request, referencing the Freedom of Information Act, must be submitted to the Director of Insurance for desired documents. The standard charge for copies is 25¢ plus tax per page copied. There is also a fee for the labor involved in researching and making copies. Copies for some items, like insurer annual reports, have a standard cost imposed based on the effort required to make the copies, as well as the number of pages. Your written request should be mailed to the Department's Legal Division.
